These Terms of Service (“Terms”) govern your use of RPGym, including the RPGym mobile application, website and related services (“RPGym”, “the Service”, “we”, “us” or “our”).

By creating an account or using RPGym, you agree to these Terms.

You must be at least 16 years old to create or use an RPGym account.

If we reasonably determine that an account belongs to a person under 16, we may restrict, suspend or delete the account.

You must provide accurate information when creating and maintaining your account.

RPGym is a fitness logging application with optional role-playing game and social features.

Features may include:

• workout and exercise logging; 
• workout templates and exercise history; 
• personal-best tracking; 
• GPS-based activity tracking; 
• integration with supported health platforms; 
• Hero progression, quests, equipment and other game features; 
• friends, private messaging and other social features. 

Features may change, be added or removed over time.

RPGym is a fitness tracking and entertainment application. It is not a medical service and does not provide medical diagnosis, treatment or professional health advice.

Information shown by RPGym, including exercise performance, heart-rate or health-platform data, estimated progress, achievements or other fitness information, should not be treated as medical advice.

You are responsible for determining whether an exercise or activity is appropriate for you.

Stop exercising and seek appropriate medical assistance if you experience concerning symptoms.

You are responsible for maintaining the security of your account and for activity performed through it.

You must not:

• share or sell your account; 
• impersonate another person; 
• attempt to access another user's account; 
• interfere with RPGym's security or operation; 
• use automated systems to abuse or manipulate the Service. 

You should notify us if you believe your account has been compromised.

RPGym may award game progression, achievements, rewards or other benefits based on logged activity.

You must not deliberately falsify workout information, manipulate the Service, exploit bugs, automate activity or otherwise obtain game rewards dishonestly.

We may correct or remove improperly obtained progression, rewards, items or other account data.

RPGym may allow eligible users to find friends, view limited public Hero information and exchange private messages.

You are responsible for what you send or publish through RPGym.

You must not use RPGym to:

• harass, threaten, intimidate or bully another person; 
• discriminate against or abuse people based on protected personal characteristics; 
• promote hatred or violence; 
• sexually exploit or endanger children; 
• send scams, fraud, phishing or deceptive solicitations; 
• distribute spam; 
• recruit users into extremist organisations or harmful activities; 
• repeatedly send unwanted political, ideological, religious or commercial recruitment messages; 
• publish another person's private information without permission; 
• send unlawful, obscene or otherwise seriously harmful content. 

We may investigate content reported to us or otherwise brought to our attention.

RPGym provides tools that may allow users to block and report other users.

Reports may be reviewed by authorised RPGym administrators.

We may take action including:

• removing content; 
• restricting social functionality; 
• issuing warnings; 
• suspending accounts; 
• terminating accounts. 

We are not required to take a particular action in response to every report.

To protect users and the integrity of moderation processes, we may not disclose who submitted a report or detailed information about moderation decisions.

You retain ownership of content you submit to RPGym.

You give us a limited licence to store, process and display that content as reasonably necessary to operate, secure and moderate the Service.

For example, this allows us to deliver a message to its recipient or display your Hero information to a friend.

You must have the right to submit any content you provide.

RPGym and its software, artwork, designs, game systems, branding, text and other content are owned by us or used under licence.

Except where permitted by law, you may not copy, redistribute, reverse engineer, sell or commercially exploit RPGym content without permission.

“RPGym” and associated branding may not be used in a way that suggests endorsement or affiliation without our permission.

RPGym relies on third-party services to provide parts of the Service.

These may include providers of:

• cloud hosting and databases; 
• authentication; 
• email delivery; 
• push notifications; 
• mapping; 
• Apple Health and other device health integrations. 

Your use of some integrations may also be governed by the terms and privacy practices of those providers.

Where you choose to connect a supported health platform, RPGym may read or write permitted workout information according to the permissions you grant.

You can control health permissions through your device or platform settings.

RPGym does not guarantee that third-party health data will always be available, complete or accurate.

Some activity types may optionally use device location to record distance, pace or routes.

Location tracking is used only when permitted by you and required for relevant features.

GPS measurements can be inaccurate because of device, signal, environmental or platform limitations.

We aim to keep RPGym available and reliable but do not guarantee uninterrupted or error-free operation.

Features may temporarily be unavailable because of maintenance, technical problems, third-party outages or other circumstances.

You should not rely on RPGym as the sole permanent record of information that is critical to you.

You may stop using RPGym at any time and may request deletion of your account through the available account controls.

We may restrict, suspend or terminate an account where reasonably necessary, including for:

• violation of these Terms; 
• fraud or abuse; 
• serious or repeated misconduct; 
• security risks; 
• legal or regulatory requirements; 
• confirmed ineligibility based on age. 

Where appropriate, we may provide notice before taking action.

When an account is deleted, we will delete or de-identify personal information in accordance with our Privacy Policy, subject to information we reasonably need to retain for legal, security, fraud-prevention or dispute-resolution purposes.

Some information may remain temporarily in backups or logs before being automatically removed.

RPGym is an evolving service.

We may modify features, game balance, progression systems, rewards, availability or technical requirements.

Game items, Gold, XP, equipment and similar virtual elements have no real-world monetary value unless we explicitly state otherwise.

We may update these Terms from time to time.

If a change is material, we may notify you through RPGym and require you to accept the updated Terms before continuing to use the Service.

The effective date at the top identifies the current version.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.

To the maximum extent permitted by law, RPGym is provided without guarantees beyond those that cannot legally be excluded.

We are not responsible for indirect or consequential loss arising from use of the Service where such liability may lawfully be excluded.

Nothing in these Terms limits liability that cannot legally be limited.

These Terms are governed by the laws of Victoria, Australia.

Any dispute is subject to the jurisdiction of the courts and tribunals that have authority in Victoria, subject to any rights you have under applicable consumer law.
